NEW Requirements for EU Safety Data Sheets

The European Commission has published Regulation (EU) 2020/878, amending the annex II of REACH regulation, that sets the requirements for chemical safety data sheet in the European Union.

Regulation shall apply from 1 January 2021, after its publication in the Official Journal of the European Union.

We have summarized the main changes introduced by this new regulation:

Section 1 of the SDSs must now includes:

  • The word “nanoform” if the sheet pertains to one or more nanoforms, or substances that include nanoforms. The reference should be placed in the product identifier.
  • The Unique formula identifier (UFI code) when the mixture has one.

In section 2, regarding Hazard Identification, the communication through the supply chain for endocrine disruptors will be improved.

Section section 2.3 (other hazards) must include information on whether the substance meets the criteria for persistent, bioaccumulative and toxic or very persistent and very bioaccumulative and information on whether the substance was included in the list established in accordance with Article 59(1) for having endocrine disrupting properties.

In Section 9, the description of the physical and chemical product properties should be more explicit.

Others sections

In addition, the statements of some sections have been changed, and new ones have been added:

  • In Section 11, section 11.2 is added with Information on other hazards, which includes two other subsections: the section 11.2.1. Endocrine disrupting properties, with information on adverse health effects caused by endocrine disrupting properties shall be provided, where available, for the substances identified as having endocrine disrupting properties in Subsection 2.3; and the section 11.2.2. Other information, which will include other relevant information on adverse health effects even when not required by the classification criteria.
  • Section 12 about Ecological Information includes the new section 12.6. Endocrine disrupting properties, with information on adverse effects on the environment caused by endocrine disrupting properties shall be provided where available, for the substances identified as having endocrine disrupting properties in subsection 2.3. This information shall consist of brief summaries of the information derived from application of the assessment criteria laid down in the corresponding Regulations ((EC) No 1907/2006, (EU) 2017/2100, (EU) 2018/605), that is relevant to assess endocrine disrupting properties for the environment.

The previous SDS redacted according to the previous version of Annex II of REACH, may continue to be used until 2022, but at Siam we work daily to update our products in the event of any regulatory change, and we adapt our safety data sheet software to include all the legal revisions that are emerging these months.
