Published the 15th ATP of the CLP Regulation - application of the regulation (UE) nº 2020/1182
The objectives of Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures (CLP) are to ensure a high level of protection of human health and the environment as well as the free movement of substances, mixtures and articles. These objectives are fulfilled, inter alia, by establishing a list of substances with their harmonised classifications and labelling elements at Union level. Its article 37, in order to guarantee that the regulations are adapted to technical and scientific progress, empowers the Commission to quickly include substances in Table 3 of Part 3 of Annex VI, where it finds that the harmonisation of the classification and labelling is appropriate.
Therefore, after analyzing the latest recommendations issued by the Committee for Risk Assessment (RAC) of the European Chemicals Agency (ECHA), as well as on the comments received from the parties concerned, Delegated Regulation (EU) 2020/1182 of 19 May 2020 has just been published on 11 August 2020, in order to adapt the normative to scientific and technical progress. The new regulation introduces:
- ● Proposals to introduce harmonised classification and labelling of certain substances and to update or delete the harmonised classification and labelling of certain other substances have been submitted to the European Chemicals Agency pursuant to Article 37 of Regulation (EC) No 1272/2008. Based on the opinions on those proposals issued by the RAC, as well as on the comments received from the parties concerned, it is appropriate to introduce, update or delete the harmonised classification and labelling of certain substances, some of which are commonly used, such as nitric acid in concentrations above and below 70% (CAS 7697-37-2) and silicon carbide fibres (CAS 409-21-2 y 308076- 74-6).
- ● With regard to the substance lead (CAS 7439-92-1), RAC proposed in its opinion of 30 November 2018 to apply the same environmental classification to the massive and the powder form. However, after reconsidering this decision, the environmental classification for the EN 6 EN massive form will not be included in Annex VI to Regulation (EC) No 1272/2008 until RAC has had the opportunity to deliver a revised opinion.
- ● With regard to the substance 2-butoxyethanol (CAS 111-76-2); ethylene glycol monobutyl ether, new scientific data has been made available for the hazard class ‘acute toxicity (inhalation)’. Therefore, it is established the need for a revised opinion based on the new information, while all other hazard classes covered by the latest CER opinion must be included.
Table 3 of part 3 of annex VI is therefore modified, as set out in this annex.
The entry into force of the new regulations, after its publication on August 11, is scheduled for August 31 and application will be mandatory from 1 March 2022.
