Service Level Agreement - Privacy policy

This Privacy Policy (“Privacy Policy”) explains how Soluciones Informaticas Ambientales, S.L. (“SIAM”) collects, uses, and discloses your personal information, whether you visit Siam at https://www.siam-it.com, https://www.sdsarea.com (the “Website”), submit your information as a potential customer (“Contact”) on the website, and/or use any of the Siam applications known as: Chemeter (desktop), Chemeter Updater (desktop), SdSArea Client (desktop), SdSArea (web app) (“Apps”), as a registered customer of Siam (“Customer”). Collectively, the Apps, Website, and any other services provided by Siam, are the “Service.”

By continuing to use the Service, you agree to this Privacy Policy and consent to the collection and use of your personal information as set forth in this Privacy Policy.

1. WHAT TYPE OF INFORMATION DOES SIAM COLLECT AND FOR WHAT PURPOSES?

Siam collects the following types of personal information while you use the Service.

A. Personal Information You Provide to SIAM Directly.

SIAM collects the personal information that you directly provide to SIAM, whether through the Apps, Website, via email, or via any other communication method.

For example, if you fill out and submit the “Contact Us” form on the Website, SIAM collects the personal information that you voluntarily provide in the form (e.g. your name and contact information) and uses this information to contact you. If you choose to opt-in, SIAM will also use your email address to send you marketing newsletters and communications about the Service. You may unsubscribe from these marketing communications at any time by following the opt-out instructions in any one of these emails.

If you become a Contact, SIAM collects the personal information that you voluntarily provide in the form (e.g. your name, contact information, username, password, phone number, email address, address, and business field) and uses this information to identify and contact you.

In addition, to become a Customer, SIAM requires your personal contact information, such as your name, phone number, your company’s physical address, technical contact person, emal address, and fiscal identification number (e.g., CIF in Spain, VAT number in EU, or similar number as applicable in your country). Siam uses this information to process your registration and login information for your Customer account.

B. Personal Information Collected Automatically.

When you use the Apps, there is certain information that SIAM, or its Service Providers (as defined below), will automatically collect from the device (e.g. your smartphone, computer, or tablet) that you are using to visit the Website including, without limitation, your IP address and/or device ID, and “Log Information,” such as your browser type, operating system, referral and exit pages, and your access times. Depending on the country you are from, this information may be considered “personal information.” SIAM and its Service Providers use cookies and log files to automatically collect this information. For more information on our use of cookies, please refer to Section 3.

2. THIRD PARTIES AND YOUR PERSONAL INFORMATION.

A. Service Providers.

Like many companies, Siam uses tools from service providers to help SIAM operate the Service (“Service Providers”), and depending on the service, these Service Providers may have access to your personal information. Although SIAM contractually requires all Service Providers to use your information in connection with the requested services, to treat your information as confidential, and to only use it for the services SIAM needs, Siam does not control Service Providers’ actual use of your information and Siam is not responsible for Service Providers’ use of your information for purposes not authorized by SIAM.

B. Business Transfers.

As SIAM continues to develop its business, SIAM may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of its assets are acquired or SIAM merges with a third-party, your information will likely be one of the transferred assets. You understand and agree that SIAM reserves the right to transfer any information collected from you in the event of any such transfer. In such event, SIAM will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

C. Legal.

SIAM may disclose information you provide to respond to subpoenas, court orders, requests from authorities, other legal process, and to establish/exercise its legal rights. SIAM may also disclose your information to defend against legal claims when SIAM believes that disclosure is necessary to protect its rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. SIAM may share your information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person or as otherwise required by law.

3. COOKIES.

A. What are Cookies?

A cookie is a small text file that is stored on your computer by a website you visit. Most commonly, websites use cookies to identify Contacts, remember Contacts’ preferences, and to keep Contacts logged into their accounts while they navigate the website. Cookies are either first-party cookies, which belong to the domain you are visiting, or third-party cookies, which are set by and belong to a different domain than the one that you’re currently visiting.

B. What Kind of Cookies are Used on the Website?

SIAM uses first-party cookies that are essential to operate the Website. For example, if you are a Customer, SIAM will use cookies to identify and remember you while you are logged into your account.

4. HOW LONG WILL SIAM KEEP MY PERSONAL INFORMATION?

How long SIAM stores your personal information will depend on the purpose that Siam originally collected it for. SIAM will not retain personal information for longer than is necessary for our business or for legal requirements.

5. THIRD-PARTY LINKS AND SERVICES.

The Website may contain links to third-party websites, services, or applications. If you choose to visit these third-party links, the use of your information will be governed by such third party’s privacy policy. Please review that third party’s privacy policy to learn how your personal information will be collected and used by that third party.

6. SECURITY.

The security of your information is important to SIAM. SIAM follows generally accepted industry standards to protect your information, both during transmission and once it receives your information. However, no method of transmission or storage is 100% secure, and SIAM cannot guarantee your personal Information’s absolute security.

7. STORAGE AND RETENTION.

Personal information that SIAM collects under this Privacy Policy is transferred to and stored on SIAM’s local servers and cloud-based data hosting Service Providers, which may be located in Europe. SIAM retains your Personal information in compliance with the General Data Protection Regulation (“GDPR”) and other applicable privacy regulations.

8. ACCESS TO YOUR DATA; EU DATA RIGHTS.

A. Legal Basis for Processing.

Our legal basis for collecting, using, and sharing your personal information will depend on the purpose for which SIAM uses your personal information. Typically, SIAM will rely on the following legal bases for processing your personal information: (i) your consent; (ii) where our processing is in our legitimate interest or in the legitimate interest of Service Providers; or (iii) where our processing is necessary to perform a contract with you (e.g. to provide you access to the Apps). If Siam relies on your consent to process your personal information, you have the right to withdraw your consent at any time.

B. Your Personal Information Rights.

If you would like to exercise your rights of access, rectification, erasure, restriction of processing, data portability, and/or your right to object to the processing of your

C. Transfer of Personal Information Outside of the EU.

Because some our Service Providers are located in countries outside of the European Union, your personal information will be transferred to other countries that may not offer the same level of data protection as the laws of your country of residence.

D. How to File Complaints.

If you believe your rights under GDPR have been violated, you may lodge a complaint with the supervisory authority of your country of residence.

9. CHANGES TO THIS PRIVACY POLICY.

SIAM reserves the right to change the terms, conditions, and notices under which the Service is offered, including but not limited to the charges associated with the use of the Service and personal information. When SIAM does, SIAM will update the revision date at the top of this Privacy Policy. Your continued use of the Service indicates your agreement to the modified terms, conditions, and notices.
