Publication of the second draft of Vietnam's National Chemical Law

The draft of this law, which will replace the current Law on Chemical Substances of 2007 (06/2007/QH12), specifies regulatory requirements for chemical substances throughout their life cycle. Following the publication of the first draft on 13 March 2024, the National Assembly of Vietnam published the second draft of the Law on Chemical Substances on 5 March 2025 in order to modernise Vietnam's chemical regulatory framework while aligning with global standards. As of this date and through the Vietnam Chamber of Commerce and Industry (VCCI), a public consultation on this draft is launched. It is expected to enter into force on 1 January 2026.

The main amendments are set out below:

  • Definitions of regulated chemicals. Significant changes are introduced to the concept of regulated chemicals as categories such as toxic chemicals and chemicals subject to mandatory declaration are removed; others such as the category ‘restricted chemicals’ are replaced by ‘chemicals requiring special control’.
  • Classification and Labelling of Hazardous and Toxic Chemicals. The classification of chemicals follows the technical guidelines of the Globally Harmonised System of Classification and Labelling of Chemicals (GHS) and the classification rules of the Ministry of Industry and Trade of Vietnam.
  • Management of regulated chemical activities according to life cycle stages.

  • Chemical substances in products. Manufacturers and importers will be obliged to publish information regarding the content of hazardous chemicals in their products in the National Chemical Database; they will also be obliged to develop management procedures for the control of hazardous chemicals during the manufacturing process following the guidelines issued by the government.
  • Transitional provisions.
    • Companies that have been granted permits to manufacture, market or export/import chemicals prior to the entry into force of the law may continue to do so until their permits expire.
    • Companies with certifications for the conditional manufacture and/or trade of chemical substances may continue their activities until 31 December 2027.
    • In the case of chemical storage, accident prevention and response plans must be in place by 31 December 2027.
