On 3 June 2025, the Peruvian Ministry of Health (MINSA) approved by Supreme Decree N° 007-2025-SA the Regulation of Law N° 31182 which protects the health and physical integrity of people from lead content in paints and other coating materials.
Lead exposure poses a significant health risk, especially to children, pregnant women and other vulnerable groups as it can cause neurological damage, developmental delays and multiple conditions.
The objective of this regulation is to align Peruvian standards with international regulations adopted by the European Union and the United States, as well as to minimise the risks associated with lead exposure, especially in urban and domestic environments.
The regulation establishes that paints and coating materials must not exceed 90 parts per million (ppm) of lead, in accordance with international standards and the Peruvian Technical Norms (NTP).
The regulation also establishes labelling requirements and obliges manufacturers and importers to modify their formulations to ensure compliance with this provision.
This decree requires all paint products and coating materials manufactured, imported or sold in Peru to comply with the new lead concentration thresholds, ensuring safer paints in the market.
The Ministry of Health (Minsa), through the General Directorate of Environmental Health and Food Safety (DIGESA), will supervise compliance, while the National Institute for the Defence of Competition and Protection of Intellectual Property (INDECOPI) will be in charge of verifying product labelling and advertising. Regulatory bodies may carry out inspections, with or without prior notice, and take samples at the places of manufacture or marketing, respecting at all times the right to inviolability of the home where appropriate.
The decree will enter into force six months after its publication in the Official Journal.
