Following a ruling by the Court of Justice of the European Union, the Commission has annulled the harmonised classification of titanium dioxide powder (with specific characteristics) and the associated labelling requirements.
On 10 December 2025, the European Commission published a notice (Communication C/2025/6670) announcing the removal of the harmonised classification of titanium dioxide (TiO₂) in powder form containing 1% or more of particles with an aerodynamic diameter equal to or less than 10 μm, previously considered as a category 2 carcinogen. This decision stems from the judgment of 1 August 2025, which confirmed the partial annulment of Regulation (EU) 2020/217.
As a result, the legal text deletes the row corresponding to titanium dioxide (index number 022-006-00-2) and removes Annexes I and II, as well as Notes W and 10 included in Annex III, which established specific labelling requirements for mixtures containing TiO₂ using statements EUH211 and EUH212.
With this amendment, there is no longer any legal obligation to apply these warnings or to consider titanium dioxide powder containing 1% or more of particles with an aerodynamic diameter equal to or less than 10 μm as carcinogenic under EU law.
